M88 Malaysia Provided 12 Years of Legal Service for “Sino-German Cooperation Project - Beijing Nangong Waste Incineration Power Plant” Until Its Successful Completion of First Grid Connection

Beijing Nangong Waster Incineration Power Plant (the “Project” or the “Plant”) is located at Daxing District, Beijing, with a total investment of RMB 813 million, a treatment capacity of 1000 tons per day, and an annual power generation capacity of 20.6 MWh. M88 Malaysia provided legal service for the Project from March 2005 until the Plant’s successful completion of first grid connection in June of this year.

The Project is a fiscal cooperation project within Sino-German Fiscal Cooperation Framework. The loan of EUR 55 million from German Government was advanced by acting through KfW. On the part of Chinese government, Beijing Municipal Government appointed Beijing Municipal Management Committee (the current Beijing Urban Management Committee) (the “Government Party”) as the tenderee to invite international design consultancy institutions to bid for the Project. Trough over ten years of cooperation, coordination, negotiations and fights with or against the Government Party, the Construction Agent, international design consultancy institutions, international bid-invitation agencies, general electronic-equipment contractors, concessioners and bidders, JunHe solved legal issues one after another, and its service team remained stable and was highly recognized for their constant quality and professional services.

Also, the Project is one of Beijing significant projects. Being a project of environment-friendly waste treatment and power generation with renewable energy resources, the Project is also the sole waste incineration facility in the south of Beijing. Its start-up has created a full industrial chain of “transport, stockpile, incineration and burial” for waste treatment in the south of Beijing.
